Terms of Service

By downloading, installing, or using the Wallcube mobile application or related services (the "Service"), you agree to these Terms of Service. Please read them carefully.

1. The Service

Wallcube ("we", "us", "our") operates this Service. Wallpapers that match your mood. iOS lock-screen wallpapers, mood-curated, with a Daily Drop. Access is provided on an "as is" and "as available" basis.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, solely for your personal, non-commercial use.

You may not: copy, modify, reverse-engineer, decompile, sublicense, sell, rent, or attempt to extract the underlying source code; remove or alter any proprietary notices; or use the Service for any unlawful purpose.

3. Apple App Store Standard EULA

If you obtained the Service from the Apple App Store, the Apple Standard End-User License Agreement also applies to your use, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms and the Apple Standard EULA conflict, the Apple Standard EULA governs.

You acknowledge that these Terms are concluded between you and us only, not with Apple, and that we (not Apple) are solely responsible for the Service and its content. Apple has no obligation to provide maintenance and support for the Service. Apple is a third-party beneficiary of these Terms and may enforce them against you.

4. Eligibility

You must be at least 13 years old (16 in the European Union) to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian.

5. Your Account

You authenticate via Sign in with Apple. You are responsible for maintaining the confidentiality of your device and Apple ID and for all activity that occurs under your account. Notify us at info@wallcube.com if you suspect unauthorized access.

6. Account Deletion

You may delete your account at any time from within the Service ("Delete Account" inside the app). On confirmation we revoke your API tokens, clear your push tokens, and remove your data from active systems (App Store guideline 5.1.1(v)). Once deleted, your account cannot be restored.

7. User Content and Conduct

If the Service lets you submit content (handles, likes, votes, posts, uploads), you retain ownership but grant us a worldwide, non-exclusive, royalty-free license to host, store, and display that content solely to operate the Service.

You agree not to submit content that is illegal, infringing, deceptive, defamatory, obscene, harassing, or that violates third-party rights, and not to interfere with the Service or other users.

8. Intellectual Property

The Service, including its branding, UI, code, and bundled assets, is owned by us or our licensors and protected by applicable laws. Assets shipped with the Service (e.g. wallpapers, icons, illustrations) may be used only as the Service intends and may not be redistributed, resold, or used to train models without written consent.

9. Push Notifications

If you grant notification permission, we may send you push notifications. You can disable them at any time in your device settings (Settings → Notifications → Wallcube on iOS).

10. Privacy

Our handling of personal data is described in our Privacy Policy, which is part of these Terms.

11. Service Availability and Changes

We strive for reliable availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. We may release updates that change features or remove functionality.

12. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Wallcube and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total aggregate liability shall not exceed fifty euros (EUR 50) or the amount you paid us in the twelve months preceding the claim, whichever is greater.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any conduct we believe violates these Terms or harms other users, third parties, or our interests. On termination, the licenses granted to you cease immediately.

15. Export Compliance

You may not use or export the Service in violation of any applicable export-control laws or to any country or person prohibited by such laws.

16. Changes to These Terms

We may update these Terms. The date at the top reflects the most recent revision. Material changes are surfaced in the app on next launch. Continued use after changes constitutes acceptance.

17. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which Wallcube is established, without regard to conflict-of-laws principles. Disputes shall first be resolved through good-faith negotiation. If unresolved, exclusive jurisdiction lies with the competent courts of that jurisdiction, except where mandatory consumer-protection law of your residence requires otherwise.
